Distance Sales Agreement

1. Parties

This agreement is concluded between the Seller and the Buyer identified below and takes effect on the date the Buyer confirms the order electronically.

Buyer

The person placing the order; name, address and contact details as entered in the order form.

2. Subject

The subject of this agreement is the determination of the parties’ rights and obligations under the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of the goods and services ordered electronically by the Buyer through the Seller’s website denizmatbaa.com, whose characteristics and sales price are specified below.

3. Goods and services

The main characteristics, quantities and VAT-inclusive prices of the products, the shipping fee and the total are shown in the order summary before the order is confirmed and are recorded in the copy of this agreement made at the time of the order.

Prices include 20% VAT. The products are made to order according to the material, size, quantity and options chosen by the Buyer, using the file uploaded by the Buyer or prepared with the design service and approved by the Buyer.

4. Payment

Payment is made by credit or debit card through the secure payment page of the licensed payment institution PayTR, in the order currency. For orders in foreign currency, the exchange rate at the time of the order is fixed and the invoice is issued in the order currency. Instalment interest, if any, is applied by the Buyer’s bank. The order enters production after the payment reaches the Seller; the Seller has no obligation to produce orders whose payment is not completed.

5. Delivery

  • Depending on the Buyer’s choice, the product is shipped by courier to the address given by the Buyer or handed over at the Seller’s workshop (Konuksever Mah. Kızılırmak Cad. A Blok No: 135 A/A Muratpaşa / Antalya). The shipping fee is TRY 150 (incl. VAT) and is borne by the Seller for orders of TRY 3,000 or more.
  • For express “same day” products, orders whose payment and file approval are completed by 11:00 are ready at 19:00 on the same day (Monday–Saturday); standard production takes 5 business days; courier delivery usually takes 1–3 business days. Delivery never exceeds 30 days from the order date.
  • The Buyer should inspect the parcel in the presence of the courier and, if it is damaged, refuse it with a damage report and notify the Seller.
  • If the Seller finds that it cannot deliver the ordered product due to force majeure or extraordinary circumstances, it will notify the Buyer immediately and refund the amount paid within 14 days at the latest.

6. Print file and approval

The Seller checks the uploaded file for print suitability (resolution, colour mode, bleed, size) and asks the Buyer for corrections or approval if necessary. The Buyer is responsible for the accuracy of the text, spelling, numbers and content in the file. Content errors in a file printed with the Buyer’s approval are not considered defects. Minor colour differences between screen and print and the technical tolerances stated in the Print Terms are not defects.

7. Right of withdrawal

Under Article 15/1 (ç) of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for goods prepared in line with the Buyer’s requests or personal needs. The print products covered by this agreement are made to order and fall under this exception; for the design service, the right of withdrawal cannot be exercised if performance has begun with the Buyer’s approval (Art. 15/1 (ğ)). The Seller accepts cancellation requests made before the order goes to print and refunds the amount.

8. Defective products and refunds

In case of defects caused by the Seller, such as print errors, the wrong product or transport damage, the Buyer may choose free reproduction, a refund or a price reduction in proportion to the defect under Article 11 of Law No. 6502. Refunds are made within 14 days of the acceptance of the return to the card and in the currency used for payment; the time it takes to appear on your card depends on your bank.

9. Personal data

The Buyer’s personal data is processed under the Privacy Notice (KVKK) for the conclusion and performance of this agreement.

10. Disputes

Disputes arising from this agreement are heard by the consumer arbitration committees at the Buyer’s or Seller’s place of residence within the monetary limits announced annually by the Ministry of Trade, and by consumer courts above those limits. If the Buyer is a merchant, the Turkish Commercial Code and general provisions apply and the courts and enforcement offices of Antalya are competent.

11. Entry into force

The Buyer confirms having read and understood the preliminary information on the main characteristics of the goods, the sales price, the payment method and delivery, and having given the necessary confirmation electronically. The agreement enters into force when the order is confirmed; a copy as of the order date is kept on the order page (“My agreements”) and notified to the Buyer by email.
